Under Michigan law a person may apply to have one felony or two misdemeanor convictions expunged from their record. This would mean that only courts and government agencies will be able to see a conviction that has been set aside. (Mich. Comp. Laws Ann. § 780.623 (2018).)
Are you eligible for an expungement/set-aside of your criminal record?
- If you have been convicted of not more than ONE FELONY, and not more than TWO MISDEMEANORS, you may be eligible to apply to have your felony conviction set-aside.
- If you have a conviction of not more than TWO MIDEMEANORS and NO FELONIES, you may be able to petition to have one or both misdemeanors set-aside.
- Five years have passed since your conviction, release from prison, or discharge from parole (Including all fees and fines paid) before you can apply to have your record set aside.
Who is NOT eligible for an expungement/set-aside of their criminal record?
- Felony conviction or an attempt to commit a felony conviction for which the maximum possible penalty is life imprisonment.
- convicted of felony domestic violence and have a previous misdemeanor domestic violence conviction.
- You were convicted of fourth-degree criminal sexual conduct on or after January 12, 2015 (convictions for this offense can be set aside if they occurred before January 12, 2015 and you have no other convictions on your record other than two minor offenses)
- convicted of committing (or attempting to commit) one of the specified child abuse, child sexual abuse, or criminal sexual assault crimes
- the conviction is a traffic offense, including driving while intoxicated offenses.
- You were convicted of a human trafficking offense
